The Goldwater Institute's Scharf-Norton Center for Constitutional Litigation, which represented TrainMeAZ, LLC, was granted summary judgment for its client Thursday by the Arizona Court of Appeals, preventing Phoenix from blocking the ads. Phoenix had forced them down a mere nine days after they were posted under contract more than three years ago. The ads feature a large red heart with the words "Guns Save Lives" and the line "Educate Your Kids," with contact information: TrainMeAZ.com. Officials at the time told Alan Korwin, owner of TrainMeAZ, that the message was too controversial and had garnered a complaint, and so had to be removed or changed. In court, the case revolved around the city's changing standards and the ad's accompanying small text, designed to motivate bus riders to go to the website and sign up for real firearms-safety training. The City's rules require ads to "adequately display" a commercial advertisement. The rules are enforced in haphazard fashion, so that people cannot know which ads will be allowed or censored. It is a shame that the City of Phoenix constantly invites litigation by refusing to adhere to the state and federal constitutions. An open letter to the President of the United States
Re: Increasingly common public slaughter
Dear Mr. Obama,
I agree with your recent remarks -- it's terrifying to have all these shootings. I want it to stop as much as you or anyone. And I share your frustration in seeing nothing get done.
What I don't understand is why you keep trying to do the same things and get blocked.
You know that those plans will meet with fierce resistance. Instead, try something that the community at large might accept, and finally move us ahead. Work both sides.
Stop harping about background checks, with the now tired litany about how it's so reasonable, yet you can't even get that.
Well, OK, you can't. It's time to accept that. But you don't seem to know why. The gun owners out here know why.
The shootings would not have been stopped by background checks.
It's the wrong answer to the problem.
It would have affected all of us -- and so we resist -- but it would not have "done something" about the psychotic murderers we want to stop. Let's not get into what the proposed bills really proposed, that's for another day.
So if you want to "do something" with huge grass-roots support and get it done, try promoting gun-safety training and marksmanship in schools. Watch what happens then.
Right now schools are a gaping cavern of ignorance on the subject of guns. Kids think guns are the fun blood bath they see in pop culture. Do something about that.
Work with the firearms community -- not against it. We're your constituency too. Teach gun safety and respect for arms -- like 100 million decent gun owners have -- instead of leaving the festering ignorance in place. The forbidden fruit of guns -- a word students can't even voice -- can't be helping.
Wouldn't it be nice to have the support of 100 million gun owners, instead of banging heads with us all the time? Teachers, school administrators, their unions, students, most haven't got a clue about the true role of guns in our lives and culture. Let us educate them. Let there be light.
Prominent doctors have suggested treating guns, which they too understand poorly, as germs and disease. Louis Brandeis framed it well: the best disinfectant is a little light.
Encourage gun-safety and marksmanship training for all Americans, to teach respect for this constitutionally protected property. You'll garner the significant support you seek, and do something to move a culture that has grown inured, as you have so eloquently noted, to something it should not tolerate. Get something done.
It's a good first step.

The Right to Protect and Defend Your Life and Property is Essential to the Preservation of Liberty and the Constitution
1. The Right to Keep and Bear arms goes back much farther than 1776: The main point is that there is very, very long history associated with the right to keep and bear arms that goes back farther than the “Bill of Rights. In fact America’s founders had their own Bill of Rights, The English Bill of Rights of 1689. King James II sparked the Glorious Revolution in part by attempting take away the people’s guns.
2. The founders gave us the 2nd amendment to protect us from tyranny, not for hunting and sport shooting: Key is the fact that, “Before a standing army can rule, the people must be disarmed; as they are in almost every kingdom in Europe. The supreme power in America cannot enforce unjust laws by the sword; because the whole body of the people are armed, and constitute a force superior to any band of regular troops that can be, on any pretence (sic), raised in the United States… -Noah Webster,’
3. Even the Supreme Court has ruled that individuals possess an inherent right to keep and bear arms? - U.S. v. Miller (1939) “part of the ordinary military equipment or that its use could contribute to the common defense.” If the military owns it, then the people have a right to own it. As well, - District of Columbia v. Heller (2008) The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes such as “the natural right of resistance and self-preservation.”
4. Your rights are not GRANTED by the government? The government is simply charged with protecting them. “Among the natural rights of the Colonists are these: first, a right to life; secondly, to liberty; thirdly, to property; together with the right to support and defend them in the best manner they can.” –Samuel Adams

Knowing your rights and knowing them well is what will give you the security to protect, defend and promote liberty with confidence.

In a victory for gun owners who simply seek medical care, not political philosophy, from their doctors, the U.S. Court of Appeals for the Eleventh Circuit has upheld the NRA-supported Florida’s Firearm Owner’s Privacy Act. This law was passed after an escalating series of events in which patients were harassed or denied access to services because they refused to be interrogated by their doctors about their ownership of firearms. The case, Wollschlaeger v. Governor of Florida, vindicated Florida’s attempt to protect patients from being forced to divulge personal information that is irrelevant to their own medical treatment.In challenging the law, Dr. Wollschlaeger and the other plaintiffs insisted they had a First Amendment right to routinely grill patients on their choices concerning firearm ownership, without regard to any good faith belief such information was relevant to the patient’s individual case. They also alleged the law’s proscriptions were unconstitutionally vague.
The Court of Appeals rejected these claims. “The essence of the Act,” the court’s opinion stated, “is simple: medical practitioners should not record information or inquire about patients’ firearm-ownership status when doing so is not necessary to providing the patient with good medical care.” Accordingly, the court determined that “[t]he Act merely circumscribes the unnecessary collection of patient information on one of many potential sensitive topics.”
As the court noted, nothing in the Florida law prohibits doctors from expressing their views about firearms or about any other medical or public policy issue. Rather, the law is within keeping of long-established “codes of conduct that define the practice of good medicine and affirm the responsibility that physicians bear” and “protects a patient’s ability to receive effective medical treatment without compromising the patient’s privacy with regard to matters unrelated to healthcare.”
The NRA participated in the case with a friend of the court brief in the Eleventh Circuit proceedings, and a number of the points it made are echoed in the majority opinion of the court. The brief challenged the plaintiffs’ case on several grounds, arguing that the physicians and organization do not have standing to bring the suit, that the Act does not violate the First Amendment, and that the Act is not unconstitutionally vague.
In arguing against the plaintiffs’ standing, the brief explained that the act does not “chill” the plaintiffs’ speech, as “the Act by its terms simply does not restrict the speech in which [the plaintiffs] wish to engage.”
While disputing the plaintiffs’ First Amendment claims, the brief noted that the Act is a “reasonable regulation of speech incidental to the practice of medicine.” The NRA filing explained the Act serves the State’s interest in protecting the privacy of patients, as well as the patients’ exercise of Second Amendment rights. In concluding the First Amendment argument, the brief declared, “The Firearm Owners’ Privacy Act is another reasonable regulation of the medical practice. It exhorts doctors to stick to practicing medicine when examining patients, rather than pushing their own political agendas, and it protects patients from doctors who refuse to do so.”
Plaintiffs in the case have requested additional review before a full panel of the Eleventh Circuit, but the court has not yet ruled on the petition for rehearing. In the meantime, however, patients who prefer to focus on their symptoms, and not their doctors’ politics, in the examination room should have more reason to feel at ease.source: Defending Rural Americas email 11-17/14

GOA Aims to Torpedo the Maryland “Assault Weapons” Law

A GOA-backed case is making its way through the court system right now -- a case that, if successful, would bring down one of the toughest gun laws in one of the bluest states in the Union.
To this end, GOA and its foundation (GOF) are challenging Maryland’s so-called “assault weapons” ban in the U.S. Court of Appeals for the Fourth Circuit.

In 2013, Maryland banned the possession or transfer of what it calls “assault weapons” and prohibited the transfer of so-called “large capacity magazines.”
Chief Judge Catherine Blake, a Clinton-appointee to the U.S. District Court for the District of Maryland, sided in favor of the law. But in doing so, she engaged in a form of analysis of the Second Amendment that may be without precedent in the history of the Republic.
After assuming the Maryland law “infringes on the Second Amendment,” she then ruled that its infringement upon the right to keep and bear arms could be justified as a means to better ensure Maryland’s public safety ends.

GOA’s amicus brief responds to several factually inaccurate statements made about firearms by the district court in its opinion. For example, the district judge mistakenly claims that so-called “assault weapons” are not in common use and are designed solely for offensive purposes.
Moreover, the judge claims that assault weapons fire at a greater distance and with greater accuracy than other firearms -- as if a .223 bullet fired from an AR-15 will somehow travel further and more accurately than a 7mm bullet fired from a bolt action hunting rifle.
The judge claims that the rounds fired from assault weapons have more capability than other rifle rounds to penetrate soft body armor. In reality, caliber has nothing to do with the type of rifle, and moreover almost all (if not all) rifle bullets penetrate soft body armor, so there is nothing unusual about the bullets fired by an “assault rifle.”

Finally, GOA’s amicus brief reminds the court that the proper standard of judicial review was laid out by the U.S. Supreme Court in the D.C. v. Heller decision (2008). It is the constitutional text and history that governs the right to keep and bear arms, not judicial precedent and not ad hoc balancing of interests.

How can we stand up to someone that creates a 100 dollar Federal Reserve (FR) note for 2 cents and uses the face value of the note of 100 dollars to buy a 100 dollar U.S. Security where the government has to pay them 4% in interest at the end of the year?
