Timeless words. So simple and very powerful, yet they were almost abandoned until recently.

Here is the exact timeline for presentation and adoption of our Bill of Rights including the exact dates that each state failed to ratify one amendment or another.
April 11th, 1789, Congress presented with a list of 20 amendments to the Constitution by Virginia (James Madison).
September 26th 1789, Congress sends twelve amendments to the Constitution to the states for ratification.
November 20, 1789; New Jersey rejects Article II (the 2nd of the original 12 Amendments presented to the states)
January 25, 1790; New Hampshire rejected article II
January 28, 1790; Delaware rejected article I
February 27, 1790; New York rejected article II
March 10, 1790; Pennsylvania rejected article II
June 7, 1790; Rhode Island rejected article II
Three States, Massachusetts, Connecticut and Georgia did not ratify the Bill of Rights until 1939.

Each Amendment to our Constitution is a separate and co-equal entity that, once ratified, has the authority and jurisdiction of all other articles and amendments as described in Article V of the Constitution.
" The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress; provided that no amendment which may be made prior to the year one thousand eight hundred and eight shall in any manner affect the first and fourth clauses in the ninth section of the first article; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate."
It is very simple, Congress was presented 20 Amendments to the Constitution by James Madison to which they presented 12 of the 20 to the states for ratification. The required majority of states ratified 10 of the 12 amendments presented, some states failing to ratify Article I (the original 1st Amendment), some states failed to ratify Article II. Three states failed to ratify any of the amendments presented but as the constitutional requirement of three-fourths were met, those ratified amendments became part of our Constitution, INDIVIDUALLY and have the same authority over the states as those amendments have over the Federal Government.
To say otherwise would be the same as to say the 13th Amendment, because there is no mention of authority over the states' governments, has no authority over the states. One cannot have it both ways and claim that one part of the Constitution, because there is no direct mention of authority over the states, yet claim that another article or amendment does have authority. In no way should mention of the FACT that the 13th amendment has authority over the states, as does what we term as "The Bill of Rights", should imply any form of "racism" and to claim it does is fallacious. The simple point is that one amendment has the power and authority of every other amendment and the majority of amendments protect the rights of the PEOPLE, who are the ultimate authority over both state's and federal governments.

May I also add that in the case of the 1st Amendment, it is finite in its' declaration that CONGRESS has no authority and is exactly what is meant, thus only Congress is prohibited.
In the case of the 2nd Amendment, the several "Militia Acts" violate the 2nd Amendment in establishing the National Guard and placing them under direct authority of the federal government and as a direct component of the federal military. The "Militia Acts" slowly usurped the powers of the states to have their own militia and eventually made a state's militia illegal. Also in the 2nd Amendment, the right of the PEOPLE to keep and bear arms shall not be infringed, not the right of the militia to keep and bear arms.
The 15th Amendment also makes mention of the "states" and the states actually hold all elections.
This is the same argument as the 13th Amendment and the 15th Amendments have authority over the states as well.
Notice in the 19th, 24th and 26th Amendments these is also a definite mention of authority over the states in the same way that the 15th Amendment does. Do these amendments have authority over the states and yet the 13th Amendment has no authority simply because there is no direct mention of the states? Was this an accidental omission or did the framers of the 13th Amendment opine that there was no need to include "the states" as jurisdiction over the states was implied, just as in the Bill of Rights.
We can even bring the 18th Amendment into the mix as it makes claim to;
"After one year from the ratification of this article the manufacture, sale, or transportation of intoxicating liquors within, the importation thereof into, or the exportation thereof from the United States and all territory subject to the jurisdiction thereof for beverage purposes is hereby prohibited."
Would this not exclude individuals who did not transport or sell alcohol outside of the state to which it was produced and be protected by the Commerce Clause?
(this is not a moot point due to the 21st Amendment as thousands were arrested and served prison time who made no attempt to transport alcohol and some even made alcohol to fuel their cars and never consumed the product.)

CA States Rights
The TENTH Amendment OF THE UNITED STATES CONSTITUTION:
"The powers not delegated to the United States (government) by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."
Unfortunately the federal government has unconstitutionally trampled on states' rights. Not only do many elected officials allow the intrusion, they aid in dismantling both state and individual rights by passing overbearing laws.
The Tenth Amendment was adopted after the Constitutional ratification process to emphasize the fact that the states remained individual and uniquely sovereign. Thus, any federal attempt to legislate beyond the Constitutional limits of Congress' authority is an usurpation of state sovereignty.
As governor, I will join the fight with Arizona, New Hampshire, Florida, Montana,
Tennessee, and others to regain our vital state constitutional rights. Each state must embrace its own destiny and California is no exception. The Golden State is faced with a multitude of serious problems created by our own politicians without importing more unconstitutional obstacles from Washington D.C.

Gov. Brewer: Unwitting or Willing Victim?
The author wants to know why they don't just get on with enforcing SB 1070? Gov. Brewer's duty is to deal with the clear and present danger and that is well within Tenth Amendment rights to do so. Even so, though, there is a lot that the feds can do to make AZ's life difficult (not mentioned in the article at all).

George W. took the 50 (State) National Guards away from the 50 Governors (So much for state militias). All 50 Governors protested this action as "One of the most Unconstitutional Acts since the signing of the United States Constitution (1787). THE 50 GOVERNORS WROTE A CONSOLIDATED PETITION TO THE UNITED STATES CONGRESS (HOUSE & SENATE), SECRETARY OF DEFENSE AND THE PRESIDENT OF THE UNITED STATES........BUT THE CONGRESS VOTED AGAINST THEIR OWN STATE GOVERNORS AND THE PATRIOT ACT WAS PASSED. My understanding is that the provision where the Governors had no power over their own National Guards was recinded some 18 months later.
WHAT BOTHERS ME MOST ABOUT THIS TOTALLY UNCONSTITUTIONAL ACT IS THAT MOST AMERICANS NEVER HEARD A WORD ABOUT IT ! NONE OF THE BIG TELEVISION COMPANIES AIRED IT OR NO GOVERNOR CALLED CNN, FOX, CBS, NBC AND C-SPAN AND STOOD ON THEIR HEAD ON THEIR STATE DESK AND SAID "WE WILL NOT TOLERATE THIS CRAP". So, when folks heard whispers of this, they must have just dimissed it as a rumor.
Violating the law to convict criminals of crimes, in which someone takes it upon themselves to be Judge, Jury & Executioner of those "they think are guilty" CAN NEVER BE TOLERATED UNDER THE GUISE OF "PROTECTING THE PEOPLE". THE BEST PROTECTION THAT HAS EVER BEEN DEVISED RESTS WITHIN THE PAGES OF THE UNITED STATES CONSTITUTION. NO MATTER "HOW NOBLE THE THOUGHT OR RHETORIC" WE MUST" ADHERE TO THE LAW OF THIS LAND OR BECOME AS "LAWLESS" AS MOST OTHERS IN THE WORLD. For those that like to say "WE ARE A REPUBLIC".........WHY AREN'T WE A "PURE DEMOCRACY"??....BECAUSE OUR FOUNDERS BELIEVED THAT THEIR WERE "CERTAIN GOD GIVEN RIGHTS THAT SHOULD NEVER BE SACRIFICED FOR WHAT THE MAJORITY EVER THOUGHT WAS RIGHT ". NOT THE PRESIDENT, SUPREME COURT OR THE CONGRESS OR ALL 300 MILLION CITIZENS HAVE THE "AUTHORITY" TO CHANGE THIS "CORNERSTONE" OF THIS REPUBLIC! Did not realize this but the bottom line is the only way for an illegitimate law to be legitimized is by our compliance.
The day may well be coming that the States need their national guard and for the original reasons stated in the Constitutional Convention.
Each state needs to Amend their Constitutions NOW to include right of secession.
Bottom line is simply this, we are under NO obligation to follow or comply with illegal legislation.
And it's HIGH TIME we stopped so doing. And funding their oppression.
A law is only legally enforceable if it is LEGAL in the first place.

Nullification in 2011!
Some people bandy the "N" word around, but don't really understand what it means or the painful struggle over it, The Civil war delivered a huge, almost knockout blow to the Tenth, but it seems to be coming back. I talked to multiple CA Attorney-General candidates who did not favor Tenth Amendment ascendancy, including at least one self-described "Conservative," who I engaged at a Lincoln Club forum and subsequently.
Examples were a wide RealID repudiation, then "medical marijauna" in CA, followed by an unsuccesful vote on total legalization for adults. More recently is a partial repudiation of gun laws in multiple states. Now, we have the grandaddy of modern efforts, in the form of dozens of states suing the feds over Obamacare Constitutionality. More on the way?

How can we stand up to someone that creates a 100 dollar Federal Reserve (FR) note for 2 cents and uses the face value of the note of 100 dollars to buy a 100 dollar U.S. Security where the government has to pay them 4% in interest at the end of the year?
