California and some other states have systems where law can be instituted via citizen voter initiatives. This has been a two-edged sword. On one hand, the public is empowered to bypass an unresponsive government and write its own laws, which are to be implemented with the full power of all government branches (Prop. 13 comes to mind). On the other hand, these propositions are sometimes poorly worded, mischaracterized by both sides and/or influenced/deflected by obstinate government officials and NGO campaigns (Prop. 187, Prop. 8).



This discussion  is intended to cover upcoming, proposed and already voted upon ballot propositions, or "ballot measures" and "voter initiatives," as they are sometimes referred to, with respect to their validity, legitimacy, workability, advocates and opposition, effect on the state and more. With some key measures coming up in Novembe, this should be interesting.

Utter nonsense. The so-called "science" has been largely discredited as fraudulent, with falsified data and conclusions. Over 31,000 scientists have disputed it. You are wasting your time on this site. Haven't you noticed that Al Gore is in virtual seclusion and many former supporters are now acutely embarassed?

There was actually a cooling trend for the last decade. Come to think of it, in the 1970's, some of the same people were warning us of a new ice age and probably trying to use THAT as an excuse to regulate and tax us, too.

The ideological amateurs running things are totally over their heads, pushing "green" technology, which is inadeqate to handle our needs and will cause an economic collapse that will make the 2008 crash look like a dry run. Fortunately, we will start turning that around next Tuesday, although it will take years. The excesses of your ideological brethern have sowed the seeds for their defeat. They overreached big time.

George, I agree with you about the current politically-correct "global warming" bandwagon. The planet has been warming up since the last ice age, and that was not driven by human carbon dioxide emissions. Many factors affect the weather and climate, including volcanic activity, sun spots, fluctuations in the Earth's magnetic field, and ocean currents. The Al Gore "An Inconvenient Truth" is pseudo-science: The temperature went up, then the carbon dioxide level went up. That said, carbon dioxide is a factor in heating the atmosphere, and this heating may have devastating impact on humans, so taking action now is prudent.

Personally, I think the recent warming trend has more to do with cutting down trees. Tree coverage cools the land. The energy from sunlight is captured and trapped in the tree biomass. Also, trees transpire water, which cools the air around the trees. Rain is more likely where the land is cool. I have seen landscape photographs with a forested area surrounded by treeless areas. The sky above the forested area had clouds, the sky above the adjacent treeless areas were cloudless. I call this "the Paul Johnson frying pan theory of global warming". By analogy: If you cool a cast iron frying pan in the freezer, then put the frying pan on the kitchen counter, what happpens? Water from the atmosphere near the frying pan condenses as water on the frying pan. If you heat the frying pan on the stove, then pour water on the frying pan, what happens? The water vaporizes and disappears from the frying pan. Treeless land is like a hot frying pan. Forested land is like the cooled frying pan.

Independent of the Global Warming argument, AB 32 promotes the development of non-fossil fuel energy sources. Fossil fuels reserves are limited. USA net imports of fossil fuels is $300B per year, and this dependence is a major economic security issue in addition to a large factor in our trade imbalance. Encouraging the development of non-fossil fuel energy sources is good public policy, and a long-term investment.

Independent of the Global Warming argument, Proposition 23 has nothing to do with jobs. Proposition 23 is an action by Big Oil Valero and Tesoro to discourage competition and undermine air quality regulations that might reduce their profits. Linking Proposition 23 to jobs is a cynical ploy, and reason enough to vote No. AB 32 has nothing to do with the current unemployment rate in California, and Proposition 23 will do nothing to create jobs. The current high unemployment rate and state fiscal crisis is the legacy of Republican President George Bush Jr.
You could really eliminate a lot of Carbon Dioxide if you would take one for the team and stop breathing or at least shut up.
Proposition 23 has everything to do with jobs. The pseudo science lies driving AB-32 and federal "cap 'n trade" legislation would impose huge taxes, restrictions on industrial, transportation and power generation activity which would greatly reduce jobs and economic activity. The so-called "green jobs boom" would be a drop in the bucket consolation booby prize, on our way to the poorhouse, compared withh the huge losses elswehere. It is frightening that morons are now driving policy. The nation will start to correct that on November 2.

And of course, no cause and effect link has ever been proven. The data lies made the trend look different. Now that we have found them out, it turns out that it has actually been getting colder in the last decade. Govt. and mainstream media focused on action shots of icebergs melting and polar bears looking lonely, while the Antarctic caps were actually growing. Yes, it is trending warmer, as it has in other periods in the past. The strongest correlation is actually with solar activity, which is hard to deal with. Some have suggested putting particles in the upper atmosphere to deal with it. Be careful. Be very careful.
As for your "the Paul Johnson frying pan theory of global warming" theory, personal theories have no place in setting policy that affects OUR lives and OUR fortunes. In case you didn't know, plants consume huge amounts of carbon dioxide via photosynstheis, so that is why they are most valuable in the ecosystem, besides providing us with food, construction matreials, etc.
He is actually serving as an excellent straight man, for us to discredit their absurd ideas on this site.

Analysis of Prop 32 by Mike Judge, Simi City Councilman:

This article calls PROP 32 a fraud it refers to the big bad special interests taking over our electoral process. What it doesn't say is that Union's Public and Private are Special interests and they already have taken it over. Saying that PROP 32 will take away your voice is the fraud it’s almost comical if it wasn’t so serious. 

Consider this if PROP 32 passes Unions will still have a voice in the process they just will not be able to use paycheck deduction funds (Dues) to support candidates or causes. The Union will actually have to go to their membership and explain what they want to do and why they need to do it and then they will have to ask for additional funds from their membership to pay for it. 

No longer will politicians be able to look at the “SEIU” (for example) as their personal piggy bank. The unions will actually have to go to their membership and talk to them about these causes and candidates. Go figure. 

We now know that Prop. 31 is about the financing of San Fran, Oakland, Frsno, San Jose, Los Angeles and San Diego at the expense of the rest of the State.  But it has unified Californians, from the League of Women Voters to California Republican Assembly, in support of local government.

“Prop. 31 is apparently intended for large public works projects such as the California Bullet Train.  Under Prop. 31, taxes could be pooled regionally to help fund large public works projects.  Under Prop. 31, environmental regulations and clearances could be drastically reduced or circumvented to overcome delays, lawsuits, and obstructionism.  But Prop. 31 could also be used for smaller local projects or the bailouts of insolvent cities or school districts.

Under the tax-sharing provisions of Prop. 31, suburbs could be coerced to “voluntarily” share a portion of their state road, school, and vehicle license tag revenues or forfeit them.  Unelected regional committees called Strategic Area Plans could divert the shared or forfeited taxes to plug budget and pension deficits in big cities and big school districts.”

Prop. 32 end representative government. Period. It creates unelected bodies using tax dollars to spend as they want, without the repercussion of elections.  City Councils will be for ribbon cuttings and little more.

CRA 2012 Proposition Recommendations

Gov. Jerry Brown's 7-year, 1-to 3-percent personal income tax hike on those earning $250,000 or more with a 4-year kicker of a quarter-cent hike in the CA sales tax. Prop 30 hitches itself to Brown's High Speed Rail (HSR), too. It's a kind of "caboose tax" built to cover interest on the bond debt of the "train to nowhere." Prop 30 changes the CA constitution to eliminate state funding to local governments for "mandates" and ends state funding for open-meeting costs of local legislative bodies under the Ralph M. Brown Act. Look out for local governments paying more, getting less and legislative bodies doing more behind closed doors.) - VOTE NO
Shifts CA from annual to 2-year budget cycle with implementation costs to local governments of up to tens of millions of dollars. Robert Hertzberg, former Speaker of the State Assembly, is backing this one to the hilt. It is a giant step toward Agenda 21's regional governance. Look for twice the pea-and-shell games with the budget process and with government by commission. - VOTE NO
Campaign Finance:
Stops or restricts union political payroll deductions without an annual "opt-in" authorization and prohibits government contractors (including Limited Liability Corporations) from contributing to government officials that award contracts. This is the strongest initiative on the ballot to help CA voters pick the lock on paycheck politics and the "domestic partnership" between the Democrats and public sector unions. Look for unions to handcuff this in court or in a future initiative if it passes)
Campaign Finance:
CA insurance companies pay an "insurance premium tax" not a corporate tax. This measure grants a narrowly defined premium "continuous coverage" discount for 3 groups of drivers--including military personnel--that have had a lapse in coverage. There is also some "Big Brother" language about vehicle mileage/usage linked to the coverage.  CRA TOOK A NEUTRAL POSITION
Repeals CA's 34-year-old death penalty law and permits CA Supreme Court to transfer death penalty cases currently under appeal to lower appellate or superior courts. Establishes a SAFE fund of $100 million to taken from the General Fund between 2012-2016 by the state attorney general to be distributed to local law enforcement agencies for murder and rape cases. Death penalty deterrent dies. Consequences of housing for life is potentially higher prison costs, but lower court costs since appeals process for death penalty cases evaporates.  VOTE NO
Campaign Finance:
Expands the definition of human sex/labor trafficking and multiplies jail time from more than double or triple for non-violent offenses and up to life with use-of-force offenses involving a minor. Fines jump from $100,000 to more than $1.5 million. Mandates that registered sex offenders provide law enforcement with ALL internet provider info including emails. Look for First Amendment and privacy cases in this well-intended proposal that will increase criminal justice costs to counties and cities by a couple of million and drag CA into territory usually reserved for the Feds.  VOTE YES
Campaign Finance:
A get-out-of-jail-free card for "Three Strikes" offenders with non-violent convictions. A money-saving proposal to cut prison costs, sentences and post-release parole/probation expenses. Takes the cuffs off the 1994 act, which mandated sentencing guidelines. Look for local jurisdictions to bear the brunt of retraining and resentencing costs, plus a potential crime spike.) Weaken Three Strikes. - VOTE NO
WARNING: This is a trial lawyers wet dream. This proposal allows consumers to sue--under the state's Consumer Legal Remedies Act--just about any grower, manufacturer or distributor in the food chain, even if there is no demonstrable violation. The Department of Public Health gets to eyeball the labels. Look for food prices to jump as the food industry passes along up to $1 million in annual costs to the consumer.) - VOTE NO
Campaign Finance:
This is millionaire Molly Munger's (Charles Munger's sister) personal income tax hike on anyone earning an annual income of $7,316 or above. This is a "progressive" tax rate increase of  0.4 to 2.2-percent for 12 years without ANY ability of amendment by the CA legislature. Munger dislikes Gov. Brown so while his debt-relief tax bill targets college-aged kids, hers targets early childhood education and daycare for low-income families. Place your bets on which of the "dueling tax hikes" will win. According to CA law, the one with most actual votes will trump the competition. Look for Munger to trump Brown on election day because toddlers don't vote, but their parents do. - VOTE NO, NO AND NO
This is another "Son of Proposition 98," which mandates state-funded minimums for education. This sequel is "Corporate 'Green' Goes to College." Herd the current three-legged CA multi-state tax rates into one designated pen and hit corporations with a no-choice rate tax. Sweeten the "clean-green machine" for 5 years with about half of the money, then let the public schools and community colleges pig out. - VOTE NO
Campaign Finance:
This gets the sour grapes award due to the sponsors. Check the link above. The choice is to let the Citizens Redistricting Commission lines for CA senate districts stand or let "special masters"--usually a panel of appointed, retired judges--draw the lines. Look for it to pass because few folks were happy with the assembly and congressional district lines. Overturn Senate Gerrymandering. - VOTE NO
  CRA took a different position from the CRP on Propositions 31, 33 and 40, taking the the more principled stand on Props 31 and 40. Proposition 33 is identical to two other ballot measures that CRA had endorsed in the past.  It was just few short votes of the two-thirds needed for endorsement at our Convention in April 2012, so we took a neutral position.

Isn't it amazing how every facet of Sergeant Bales life,  high school, college, employment, why he left his employment, his brother’s employment, his wife’s employment, real estate holdings, a missed house payment , a missed promotion etc., is exposed within a week and the same fact finders can't find comparable info on the most powerful man in the world in three plus years ?
