Scalia eviscerates retiring Justice Stevens' last opinion

Justice Stevens final opinion before retiring epitomizes nearly every flawed and logically flaccid argumentation in the liberal justice quiver. In the McDonald v. Chicago case, Justice Scalia concurs but also writes a separate answer to Justice Stevens, exposing the lack of rigor and coherence. I recognize that Stevens is an old man, but these traits have unfortunately been on display since his appointment by President Ford in 1975. It makes for bracing reading.
Final sentences:
“JUSTICE STEVENS abhors a system in which "majorities or powerful interest groups always get their way," post, but replaces it with a system in which unelected and life-tenured judges always get their way. That such usurpation is effected unabashedly—with "the judge's cards . . . laid on the table," —makes it even worse. In a vibrant democracy, usurpation should have to be accomplished in the dark. It is JUSTICE STEVENS' approach, not the Court's, that puts democracy in peril.”

What is disturbing is that 4 Supreme Court justices disagree with the Constitution. The point that so many people miss about the 2nd amendment is that it is our last line of defense against tyranny. The government has weapons, we need weapons. Somewhere, there should be privately owned cashes of major military hardware just in case.

Amen, Bobby. that is the main purpose of the Second Amendment, although a bunch of poorly trained and organized people with non-automatic pistols and rifles wouldn't be much of a match for a likely opponent. Home defense and hunting are the other reasons.
If things start to deteriorate, we may see the rise of organized local militias for area defense, particularly if there is an economic/political collapse. I hope it doesn't come to that.
The Swiss system of universal arming, training and service makes a lot of sense.

Ab-so-friggin-lutely! Everywhere gun control is increased so is crime. I'll bet the crime rate in DC has fallen since the Heller ruling! Violent crime in Switzerland is very very low. Elsewhere, politicians try to create target-rich environments for their criminal constitutents.

McDonald case ruling is the talk of the Conservative world
This was a very important ruling and there has been a lot of writing about it. Wall St Journal devoted quite a bit of space to it today.
The McDonald v Chicago case decision confirmed the DC v Heller case and even expanded the scope of Constitutional protections. This is especially important, since the Obamanation/Progressives are attempting to lay siege to gun rights.

Good stuff guys, I think so many of us are sitting back judging when it is time to stand up and start the march to Washington DC and demand the evacuation of the capital by all those traitors who swore to " uphold and defend the Constitution" and immediately forgot that they had never read it in its entirety. These people are basically traitors to our founding principles and will use whatever they can to usurp the power of the people to maintain a democratic Republic. So many times in our history the pathetic self appointed elite (people who never had to meet bills or a payroll) feel that it is time to step forward and take the reigns from the unwashed less that elite masses to make decisions about their own lives. "They just don't get it" is the double edged sword that they pull and it will be used against them. The really important thing is that we have to send these people back to their caves to lick their wounds. Tell everyone you know, make sure your neighbors vote on election day and vote for their own freedom.

There have been quite a few questions posed to me about how the 2nd Amendment relates to the 10th Amendment and how states are obligated to follow the 2nd Amendment.
First, there were originally 12 amendments presented for ratification as the Bill of Rights, the first two amendments actually failed the ratification process. Each amendment was ratified independently and not as a body, thus each, in turn, became its own part of the Constitution. There was a REASON that James Madison made the "9th" and "10th" Amendments last in the Bill of Rights (Actually the 11th and 12th Amendments as presented for ratification).
The 10th Amendment reads; " The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people. "
The 2nd Amendment, which was ratified individually and before the 10th Amendment, was already part of the Constitution and thus already delegated and a "...a right of the people {which} shall not be infringed", by the Federal Government nor the states as it is prohibited to the states.
We hear the term "incorporation" used when the SCOTUS deals with the Bill of Rights claiming "Due Process" and using the 14th Amendment. This is not actually valid because that would preclude the intent of the ratification process of the Bill of Rights, remember, each amendment was ratified individually and the first two amendments did not pass ratification. Using the 14th Amendment to "incorporate" the Bill of Rights to have power over the states is a ploy used by progressives as that which is incorporated, can be unincorporated.
It is both clear in Madison's intent, the ratification process and in the truth in history, that the 10th Amendment does not preclude the States from being subject to any of the preceding amendments and the states are subject to the 2nd amendment without "incorporation.

Chicago quickly enacts gun measures
Right on the heels of last week's landmark Supreme Court gun ruling upholding the 2nd Amendment, Chicago passed a new restrictive ordinance 45-0. Some alederman voting for it evidently had misgivings, so why vote for it?
"You cannot legislate criminals. They are going to be criminals no matter what," said Ald. Ed Smith, 28th. "The people who intend to do crime, they are going to do it in whatever manner they can. They are going to get a gun wherever they can, and they are going to use it. They are not going to register their gun."
After making a similar acknowledgement, Ald. Deborah Graham, 29th, issued a plea: "I also would encourage gangbangers who get those guns unlawfully to stop getting them unlawfully. We're going to increase the penalties to make sure our communities are safe." (GOOD LUCK WITH THAT ONE, SWEETIE.)

They have already significantly exceeded the offenses outlined in the Declaration of Independence. We'll give it until November 2. Then there had better be some significant improvements in representation, followed by REAL improvements in 2011, or they will have outlived any perceived utility to us.

How can we stand up to someone that creates a 100 dollar Federal Reserve (FR) note for 2 cents and uses the face value of the note of 100 dollars to buy a 100 dollar U.S. Security where the government has to pay them 4% in interest at the end of the year?
