As of today, May 17, 2013, no new semi-auto handguns will be added, or renewed, to the California Roster of Handguns Certified for Sale unless they incorporate microstamping technology. Just what is that you ask? Here is what that means according to the California Department of Justice:
“Therefore, to be listed on the Roster of Handguns Certified for Sale in California, a semiautomatic pistol must be equipped with microstamping technology-i.e., a microscopic array of characters that identify the make, model, and serial number of the pistol, etched or otherwise imprinted in two or more places on the interior surface or internal working parts of the pistol, and that are transferred by imprinting
on each cartridge case when the firearm is fired.”

Ok you say, no big deal, there are a ton of great guns already on the Roster of Handguns Certified for Sale in California, I’ll just buy one of them. Not so fast! Take a look see at that roster. Notice the certification expiration dates?

That’s right, certification expires and must be renewed every three years, you know, because the same make/model gun with no design changes suddenly will not pass the same stupid tests it passed three years ago.
I kind of think the lawmakers saw this as a long term way of eliminating guns, because as the years have gone by, they have continued to add requirements for the guns to be on the roster of approved guns. The most recent added requirement is the inclusion of a magazine disconnect device (gun will not fire without a magazine inserted). Most manufacturers have refused to comply with this asinine requirement in order to sell guns in just one state, and rightfully so. The few guns that do meet that requirement are now going to be forced to include microstamping if they want to make back on the list the next time around. To the best of my knowledge, no manufacturer is currently producing any firearms that include microstamping.
As a resident of California, it saddens me that many of the new handguns on the market are not available to us, but from a business standpoint, it makes complete sense. If I were a gun maker, I also would tell California to pound sand.
As a practitioner of law (from a cop standpoint, not a lawyer by any means), I think the residents of California may have a legitimate lawsuit against the state for essentially banning handgun sales. They may not have specifically banned them, but the net effect of their legislation is the same. It is making handguns, a type in very common use, impossible to purchase which according to the Supreme Court decision in District of Columbia v. Heller, is a violation of the Second Amendment. Looks like it is time for the California gun rights organizations to rally together and file a suit. Maybe we can get them to include assault weapons since those also fall under the “type in common use” verbiage in Heller.

Kris Koenig is the mastermind behind the upcoming documentary titledAssaulted: Civil Rights Under Fire. The project started as a look into the gun control debate raging in California, but as the debate heated up nationwide this past winter they broadened their scope to include the national debate as well. The project has been funded entirely through the website Kickstarter (initial funding –second push), where individuals pledge their own money to support a cause they believe in, and the finished product is nearing release. Kris has released a trailer that has been approved by the MPAA for use in movie theaters (see it above). The film will be shown in a limited number of theaters starting on June 20th (list coming shortly), with an “on demand” style release system planned thereafter. And to be honest, it looks like it’s a pretty darn well made product.

Still the news updates have value. sjHappy Anniversary: Today marks the 15th anniversary of the Defensive Use of Firearms website. While a large proportion of list members learned of these mailings via the website, I'm under the impression that most neglect to re-read it, from time to time. Unlike the Defensive Use of Firearms book – which also should be re-read periodically – the website is updated several times a year.

Jeff Knox on the Reininger Conviction: ...Reininger was moving from Maine to Texas, but only made it as far as New Jersey. He got tired and parked behind a building in Reading Township, a quiet, rural area of the state near the Pennsylvania line. Had he held out for another 20 minutes, there wouldn’t be a story about Dustin Reininger because he wouldn’t have had a problem in Pennsylvania, but he was tired so he stopped in New Jersey... This is what gun control laws do. They turn innocent people into criminals, destroying lives, while protecting no one... Reininger’s is not an isolated case. The names of people unjustly prosecuted – and persecuted – in the name of gun control would fill a book. The history is clear; no matter how innocuous or “common sense” a gun law might seem, once it goes into force it is inevitably used to harass and abuse gun owners... (Reininger has been convicted of violating unjust laws. Still, this is why I repeatedly title links to many of the reports from the “un-free” states “Life in...” Those who travel need to be familiar with the laws in the states they traverse and visit and need to know the limited provisions of the Firearm Owners Protection Act. A Victory for “Traditional” Ammo: The U.S. District Court for the District of Columbia today dismissed a lawsuit brought by the radical anti-hunting Center for Biological Diversity and six other groups demanding the Environmental Protection Agency ban traditional ammunition containing lead components. Traditional ammunition represents 95 percent of the U.S. market and is the staple ammunition for target shooters, hunters and law enforcement, with more than 10 billion rounds sold annually. NSSF filed a motion to dismiss the lawsuit last August. The court today agreed with NSSF that EPA does not have the authority to regulate traditional ammunition under the Toxic Substances Control Act. EPA had already twice denied attempts by CBD to have the agency ban traditional ammunition, and the court had dismissed an earlier case brought by CBD seeking the same relief... (As with much of the litigation strategy of the left, the find against lead-containing ammunition is intended to discourage the exercise of the RKBA by making it too costly.)

Bloomberg Targets Arkansas: New York City Mayor Michael Bloomberg’s gun control group is following through with its pledge to air ads against Arkansas Sen. Mark Pryor, whom Democrats see as one of their most vulnerable incumbents in a tough 2014 climate. A source tracking media spending told POLITICO the group has bought $350,000 worth of broadcast and cable airtime starting Friday and running through June 6, a crushing amount in a state where ad time is fairly cheap. The bulk of the spending is the first week of the buy, although more may be purchased in the coming days... (Interesting strategy. Pryor, unlike Ayotte and Flake, is actually up for re-election in 2014. Does Bloomie really want to make it impossible for anyone reluctant to further infringe the RKBA to serve at national level as a Democrat?)

A Red Herring in Colorado?: A federal judge assigned to hear a lawsuit filed by sheriffs challenging Colorado's new gun laws is a gun owner herself but says she doesn't believe a recusal is warranted. Judges typically disclose potential conflicts of interest in cases they hear. In court documents filed Wednesday, U.S. District Court Judge Marcia Krieger says she owns and is proficient in the use of firearms. Magistrate Judge Michael Watanabe also is assigned to the case. He doesn't own any firearms but disclosed that he has worked with two sheriffs who are among the plaintiffs. Both judges said they don't believe recusal is necessary... (Why should exercise of the RKBA disqualify a judge to hear this case? Would the exercise of free speech or membership in a church disqualify a judge from hearing a First Amendment case? Of note, the marriage of Stephen Reinhardt – the most left-leaning judge on the Ninth Circuit Court of Appeals – to Ramona Ripston – executive director of the ACLU of Southern California for 38 years – never seemed to have prompted any recusals from him.)

Unintended Consequences for Connecticut?: In a state desperate to maintain and revive its industrial base, Mark Malkowski thinks he should be getting gold stars. He started a manufacturing company at age 25, and in 10 years built it into an industry leader, with 200 employees, that sells 6,000 of its products every month at roughly $1,000 each. The company, Stag Arms, is currently almost a year behind in fulfilling orders. But when you are manufacturing AR-15 assault rifles [sic] 40 miles from Newtown in a state that has banned their sale, it is not surprising that things are more complicated. The bitter battle over new gun laws in Connecticut has passed. But two months later, gunmakers like Mr. Malkowski are still weighing their options, including moving from a state long thought of as a cradle of the American gun industry. Meanwhile, supporters of the legislation are balancing their desire to limit guns with the jobs and taxes that the gun industry provides in a country where 300 million guns are in circulation and 5 million are manufactured each year... (I'm glad to see NYT cover this but... “Assault rifle,” by definition, means selective-fire and, to the best of my knowledge, both Stag Arms and PTR only offer semi-auto rifles. And, while I'd love to see Connecticut pay the price for the latest infringement, the departure of these smaller manufacturers will pale to the impact that the departure of Colt would have.)

Still Pending in Florida: Ultimately, many of the photos and cellphone records of Trayvon Martin released online Thursday by George Zimmerman’s defense attorneys – indicating that the slain teenager smoked marijuana, got into fights at school, and had an interest in, and perhaps access to, guns – may be ruled inadmissible in court. But they are already making the rounds in the court of public opinion, which can influence everything from fundraising efforts to the mind-set of potential jurors in Mr. Zimmerman's murder trial... (CSM seems not to be troubled by the fact that most of the public – including the jury pool – knows Trayvon Martin from his cherubic-looking junior-high photo or, even worse, that some of their fellow media altered later photos to make them resemble the former.)

Meanwhile: A 19-year-old man has been identified as a suspect in an attempted burglary at a home Tuesday afternoon in suburban Delray Beach... Madeus was armed with a stolen .380 Ruger semi-automatic handgun, sheriff’s office investigators said. A 15-year-old boy, and alleged accomplice to Madeus, was shot in the arm by a resident of the home... An Atlantic High School student, who was not identified, told investigators he was home when he heard a knock at the front door shortly before 2 p.m. Tuesday. The student said he looked through the window and recognized a person who had previously threatened him at school. That person left, but the student said he heard a noise at the rear of the home about 10 minutes later. Two unknown persons were trying to enter the home. The student told investigators he found his brother’s gun, a .380 revolver [sic], and fired one shot through the door to scare the potential intruders off... (These appear to be details of the incident that I linked yesterday. All's well that ends well but I don't feel warm and fuzzy about “warning shots” or shots fired through doors – unless the door allows identification of the target, in which case it would not appear to be a “warning shot.”)

Still Pending in Illinois: The Illinois House has passed a concealed carry bill, 85-30, which would set uniform standards for concealed carry statewide. It's sponsor admits it has flaws, but feels it is the best bill given an approaching deadline for the state to pass a law as mandated by the federal courts. The bill would require those 21-years or older to pay $150 fee for a five year permit. They'd have to spend 16 hours in training, including time on the range. But the most controversial part is that it overrides home rule, effectively eliminating all local gun laws and ordinances, making everyone statewide follow the same rules. The margin in the House would override a Governor's veto, but Governor Quinn pledged in a statement to do whatever he could to defeat it, calling it "a massive overreach on the concealed carry issue that would automatically repeal local public safety ordinances including Chicago's assault weapons ban. ... The principle of home rule is an important one. As written, this legislation is a massive overreach that would repeal critical gun safety ordinances in Chicago, Cook County, and across Illinois." … (If Quinn manages to keep this bill from becoming law and no other bill is passed in time to meet the court-imposed deadline, the state could become a constitutional-carry state.)

Fighting Crime in Kansas?: A Wichita elementary school teacher is on paid suspension after being arrested for bringing a gun to school. Daniel Nagel, 31, was arrested Monday after another employee at White Elementary called 911 and reported seeing a teacher had a gun. A family member tells Eyewitness News Nagel brought the gun to protect the students and never intended to do any harm. The family member says Nagel does have a concealed carry permit. However, Wichita Police say it wouldn't make any difference because schools are a gun free zone... (Mr. Nagel does not seem to grasp the concept of “concealed.” I can't help wondering if he told that other employee that he was armed.)

Pending in Louisiana: The bill is HB8, though there’s a Senate amendment; apparently, the Legislature plans to enact the bill as amended. The bill bars the government from releasing information about who has applied for or gotten a concealed carry permit, and the Legislature certainly can impose such restrictions on the government itself. But then it also criminalizes speech by everyone else (I merge the House Bill and the adopted Senate amendment)... So blogging that you happen to know that a gun control advocate actually has a concealed carry permit himself would be a crime... Mentioning applicants’ names in giving examples of cases where you think a concealed handgun permit was wrongly issued, or wrongly denied, would be a crime, too... (I understand Volokh's First Amendment concerns but would add that there still appears to be an underlying assumption in the media that those who would misuse firearms will actually go through the permit process.)

A Victory in New Hampshire: Deadly force will continue to be a viable first option in New Hampshire for individuals defending themselves or others in a public place, regardless of whether they can safely retreat from the threat, after a Senate vote Thursday effectively leaves the state's stand-your-ground law in place. The Senate voted 19-5 to table a bill that repeals parts of a law adopted two years ago that allows people to use deadly force to defend themselves in any place they have a right to be and that does not place on them a duty to retreat first, if they can. The Senate is expected to let the measure die... Laws in at least 20 states say a person has no duty to retreat from an attacker in any place the person has a legal right to be, according to the National Conference of State Legislatures...

A Glimmer of Common Sense in New York: The Columbia County District Attorney is making good on a promise not to prosecute a man arrested under the SAFE Act. DA Paul Czajka told NewsChannel 13 he would not prosecute Gregory Dean Jr. Dean was pulled over earlier this month after police say the light over his license plate was out. Police say he also had a gun in his car. While they say it was possessed legally, it had nine rounds of ammunition, which exceeds the state's new limit of seven rounds... (Columbia County must have a pretty low crime rate if cops have the time to stop motorists for a burned-out license-plate light.)

Quis custodiet ipsos custodes?: Since 2009, Melissa Guillet was responsible for the security of seized and found property items at the Matthews Police [NC] Department. Eyewitness News learned Thursday she's accused of stealing $2,000 and a gun from evidence. She is expected to turn herself in, police said... Her neighbor said Guillet's estranged husband made a surprising comment to her a few weeks ago. "He said he had things against her to blackmail her," Hellen Kimenhour said. The Matthews Police Chief said Guillet's estranged husband told them she was stealing from the evidence locker... (I renew my advice to own at least one duplicate copy of the gun[s] you actually carry. If forced to use it, it will likely disappear into an evidence locker, perhaps permanently. Many of us have strictly recreational guns that, if needed, could be sold or traded to get those duplicates.)

Don't Mess with Texas?: The Texas Legislature on Thursday sent a bill to Gov. Rick Perry’s (R) desk that could mean some teachers will be trained as marshals and sent into classrooms with guns. State Rep. Jason Villalba (R) told KRIV that the bill was created in response to last year’s shooting at Sandy Hook Elementary School in Connecticut. “We’ve created a new class of law enforcement officers here in Texas to protect our kids in a moment of crisis,” the lawmaker noted. Villalba promised that teachers would have “80 hours of training, deep psychological profiles, training in areas of firearms, legal and emergency situations and we are going to make sure they can protect our kids in that moment.” The measure would require all firearms to be locked up “within immediate reach” while in the classroom... (“Locked up 'within immediate reach'” strikes me as an oxymoron but it still sounds better than having to run out to the parking lot to retrieve a firearm from a parked vehicle.)

Oops, Wrong House: An intruder was shot and killed during a burglary in Marshville [NC], just southeast of Monroe, according to the Union County Sheriff's Office. Union County Sheriff's Deputies were called to a report of a burglary in progress at a home off Lanesboro Road around 1 a.m. Thursday.The homeowners told the 911 dispatcher that someone had forced their way into the home wearing a mask and using a handgun. The people inside the home were able to get a loaded weapon and shoot the intruder. He died from his wounds in the front yard of the home... (It's that phrase “ were able to get a loaded weapon” that gives me a sigh of relief. What if they had not bee able to reach it in time? It's best to keep a handgun holstered on your person.)

A man who fatally shot an armed intruder in his driveway early Thursday won't be charged because he was protecting his neighbor, police said. Sgt. Richard Fischer said the intruder, believed to be in his mid-20s, was “uniquely dressed” in a bulletproof vest and what was described as military-style attire when he showed up about 12:30 a.m. Thursday at the home in the 8900 block of Hambledon Drive on the West Side [San Antonio TX]. The intruder said he planned to “get someone” at the home before he pointed the gun at a group of people inside, demanding money and a TV, officer Roger Zuniga said in a prepared statement. As the intruder walked out of the home's garage, a neighbor next door who heard the commotion went outside and shot him at least once in the face... The shooter was defending his next-door neighbor, Zuniga said, adding that though the investigation is ongoing, he likely will not be charged with a crime. Texas law allows deadly force against intruders and thieves to protect lives and property – even a third person's... (That sounds like exceptional shooting under stress.)

Oops, Wrong Store: Police say two men attempting to hold up a convenience store in Springfield [MO] early this morning were forced to flee the building after a customer disarmed one of them, took his gun and fired shots at the two robbers as they fled. The incident occurred at the Kum & Go at 2506 W. College St. shortly after 4 a.m. According to Springfield police Lt. Greg Wheelen, one of the suspects entered the building, displayed a firearm and informed the clerk that “it was a hold up.” The other suspect stayed by the door. That was when, Wheelen said, a customer “disarmed” the suspect inside. The suspect who was outside immediately ran away. Then the suspect who was inside ran, also. Wheelen said the customer fired two shots at the suspects as they ran away. Police spokesperson Lisa Cox later this morning clarified that the customer physically took the handgun from the suspect who had been in the store and used that same gun to fire at both suspects as they fled... (I don't know how Missouri law treats firing at fleeing felons. I share this mostly as just one more example of how much more common it is for a criminal to be disarmed by a victim than vice versa.)

Rules Reminder: A West Palm Beach [FL] man was hospitalized after accidentally shooting himself. It happened in the 5900 block of Cartier Road about 7:15 p.m. Thursday. Palm Beach County Fire Rescue Capt. Albert Borroto said paramedics arrived and found the man suffering from a gunshot wound to the stomach. Police said the gun accidentally fired in the man's pocket... (This appears to be, as a minimum, a violation of Rules Two and Three. I still count it as a Rule Three violation if the failure to use a proper holster – including a pocket holster – results in something other than a finger getting inside the trigger guard.)

The “Safe Time” Myth: The family of the soldier hacked to death on a London street in an apparent terrorist attack said Friday that they understood the danger he faced while deployed abroad but had not expected him to be in peril at home... (If you take nothing else from the teachings of John Farnam, heed his warning not to divide your life into “safe” and “unsafe” time. I myself experienced four high-threat incident in my last two decades in California – one in my own driveway – and the only common factor was the lack of advance warning.)

Tangentially Related: Two of the headline scandals that have hit the Barack Obama administration in recent days could be about to come together – the IRS and the invasion by government of private communications. At least that’s the way it looks, based on a report from the activist group ACLU, where staff attorney Nathan Wessler recently wrote that the most feared federal agency believes it has the right to access private emails... Now comes the report from Wessler, who explained that the IRS long has held the position that it can obtain and read a person’s emails – essentially without permission, without a warrant and without even notification...

The Obama administration won’t answer the CBS News correspondent’s questions because her investigations – into Benghazi, Fast and Furious, Solyndra – often reflect negatively on it. Some colleagues at CBS News, where she has worked for two decades and earned multiple Emmy awards, dismiss her work because they perceive a political agenda. And now, she says, someone may have hacked into her computers... In Feb. 2011, Attkisson wrote a landmark report about the Fast and Furious gun-walking scandal, which earned her an Emmy award. Months later, she went on Ingraham’s radio show and said that officials from both the White House and the Justice Department had yelled and screamed at her because of her report...
