Event Description

In Ventura County there is a critical issue brewing that warrants our united stance and a vigilant response. Recently brought to the attention of the Ventura County Libertarian Party is a particular challenge to private property rights, in which the interests of labor, agriculture and business are being assaulted. New regulations currently under County consideration may jeopardize the financial stability of County farmers and ranchers unless we get involved now.

Please come out and oppose these new onerous regulations being supported by Linda Parks.

The Board is seeking to revise the County Grading Ordinance, which could have enormous implications to common agricultural practices such as plowing, disking (cultivating soil by turning and loosening) and brush-clearing. VC COLAB hopes to positively influence the revisions that the Ventura County Public Works Agency will be making to ensure that regulation of common farming practices will not result in financial hardship for County farmers and ranchers.

Note change:

2/24: It appears that the battle is on for March 1.

Let's try to get a good turnout to offset the progressive momementum.

Well, that was a  VERY long (1030-330) session, with one 15 mineute break.

We got a good turnout of tea party people: Lana, Susan, Joyce, June, Sally, Dana, Flavio, Lauren and others. I spoke, as did several Libertarians including Dana, Flavio and Lauren. When Lana was called on to speak, much, much later, she had already left. Many farmers and ag ind. people spoke, including environmentalists, who were not all extreme greens.

GOP was not involved. I was told it is not their policy to get involved in such issues.

The Supervisors voted to defer action  on it pending further work by the stakeholders.

It was apparent that these affected were under numerous other regulatory burdens and that this is a proverbial straw to break the camel's back.

The greens kept claiming that it is only minor change, that it formalizes de facto changes, that it must be done to conform to state laws.   They also tried to greatly narrow the scope of our challenge.

"Silly local ordinances?" I suggest that you familiarize yourself with the nature of what they are attempting, the related legal issues and the much larger Agenda 21 underlying their campaign "locally," in Ventura County, as well as part of a much larger, coordinated worldwide campaign.

Even a silly little 140,000 acres in insignificant little Ventura County isn't chopped liver.

The bailouts and stimulus are only the point at which Joe Sixpack bestrirred from his Rip Van Winkle-like slumber. The problems are far broader and go back longer than that.

Again, I suggest that you read our mission statement.

Comment by James Walter Layne on February 26, 2011 at 4:49pm

Thanks for the info, Dana.  I'd love to see the proposed ordinance.

However, wouldn't this argument apply to all zoning ordinances?  Don't they all in some way restrict people from using private property in certain ways?

I'd like to know more about the issue and reserve judgment until then.  Does anyone know if the proposed ordinance is online?  Thanks!

p.s.  I agree that the Bill of Rights is not a full list of our rights. But likewise, the Constitution is not a full list of the powers of government. It is only a list of federal powers.  The States (and by extension, the localities) have every other power reserved.  This is expressed in the Tenth Amendment.

Comment by Dana McLorn on February 26, 2011 at 3:40pm
This is an attempt to deprive farmers [and other property owners] of the use of their property without due process. They aren't taking the deed from you. But they hope to limit your use to a point that you are in fact a serf. You will be unable to put the property to profitable use and enjoy the fruits of your labor. The constitution is not a full list of our rights. But rather a limit on the reach of government. When a law or regulation deprives us of our "natural rights" the people must declare it invalid and a usurpation liberty. This is why the Bill of Rights declares it's intent is not to deny or disparage any rights enjoyed by the people. This is not a "silly local law" but rather part of a larger agenda to take our individual liberty's. If we do not fight to maintain our property rights we are truly on Hayek's road to serfdom.
Comment by James Walter Layne on February 26, 2011 at 3:08pm

Appreciate that too, George.  I see your point. However, I just look to what the very essence of the Tea Party is, and it is not a reaction to silly local ordinances or anything of the sort.  It came about as a result of the bank bailouts, stimulus package, etc.. all the "last straw," so to speak, in federal usurpation and reckless spending.  In my opinion, the very strength of the Tea Party is that it's a grassroots movement, that it doesn't have a central authority... but this is also potentially a great and even fatal weakness, because it will inevitably drift off into so many other matters that are not of concern to the movement as a whole... this will ultimately ensure its demise.

I see your point that liberals at all levels of government have a disregard for the rights of private property.  However, States have far greater proper legal power over the disposition of private property rights than the Federal government. That's what makes it such a fundamentally different issue.

Is someone arguing that the zoning ordinance violates either the U.S. or State Constitution?  Is there anywhere we can look at the text of the ordinance?

Comment by Ventura Patriot on February 26, 2011 at 2:58pm

I'm with Dana. Read our Mission Satement in the "Read Me" section. We are about restoring a Constitutional Republic, not just about taxes and certainly not just about the federal level. Some say all politics are local.

Restricting property rights is definitely a huge liberty issue, even a huge Constititional issue.  It seems well within our mission, although I also recognize that we can't become too unfocused. We have not concentrated on parking meters and plastic bags, like other Tea Parties have, but can also recocognize them as legitimate issues. The question is, how many battles can we fight and which ones matter most?

Comment by Dana McLorn on February 26, 2011 at 2:41pm
While I agree with having the TEA party stick to it's uniting principles [Taxes, spending/debt and following the constitution] we must keep in mind that these violations are not limited to Washington D.C. In Jefferson's draft of the deceleration of independence he used Life, liberty and property as examples of our natural rights. The latter is what is being taken in this case. This is all part of the international progressive agenda "21". Our enemy knows no borders in this fight. Will we stand aside as our rights are deprived? Would Sam Adams and our founders not fought this injustice as well? It is time we realized our enemy is well organized and is pushing their agenda at all levels of our government[and schools]. We must stand up and say NO! Before this progressive beast devours the nation our forefathers gave us. Please stand up for liberty.
Comment by James Walter Layne on February 26, 2011 at 2:40pm
By the way Sue, that's a good argument for getting involved at the local level.  I appreciate that argument.  I still think we should do so individually. When an organization mixes its message, it necessarily weakens it.
Comment by James Walter Layne on February 26, 2011 at 2:37pm
The difference is that local and state governments have the authority to do a great deal more than the federal government.  State governments are general in authority; the federal government on the other hand has only the particular powers given it by the States in the Constitution.  So you're dealing with apples and oranges. Health care is an example... a state can do healthcare reform (within limits of course).. the federal government cannot, however, because it doesn't have authority to do so in the Constitution.  That's my main point, and for this reason I think it's not good to use the Tea Party for more local issues.  It is VERY good, however, for Tea Party "members" to get involved in local issues, especially ones where important property rights are at stake.  Does this make sense?

We need to demythologize guns before the liberal attempt to create a totemic fear of them succeeds.
